SRC-JEC S.B. 1474 78(R) BILL ANALYSIS Senate Research Center S.B. 1474 By: West State Affairs 4/14/2003 As Filed DIGEST AND PURPOSE The Fair Housing Act does not prohibit discrimination based on the source of funding of a proposed housing development. Opposition to proposed affordable housing developments is sometimes aimed toward a development being multi-family housing, but can also be targeted toward it being state-funded affordable housing. As proposed, S.B. 1474 prohibits discrimination based on the source of funding for a proposed housing development. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 301.021, Property Code, as follows: Sec. 301.021. New heading: SALE, RENTAL, OR DEVELOPMENT. (b) Prohibits discrimination based on the source of funding for a proposed housing development in the terms, conditions, or privileges of sale, rental, or development of a dwelling or in providing services or facilities in connection with a sale, rental, or development. (c) Prohibits a person from discriminating in land use decisions or in the permitting of development based on race, color, national origin, sex, disability, familial status, religion, or, except as otherwise provided by law, the source of financing of a development or proposed development. (d) Redesignated from previously existing Subsection (c). SECTION 2. Effective date: September 1, 2003.
