SRC-MSY S.B. 1493 78(R) BILL ANALYSIS Senate Research Center S.B. 1493 By: Madla Education 3/27/2003 As Filed DIGEST AND PURPOSE The current Texas Education Code requires the State Board of Education (SBOE) to provide a training course for independent school district trustees, and requires a trustee to complete any such training required by SBOE. However, the current law does not provide any repercussions for failing to complete the required training. As proposed, S.B. 1493 requires the Texas Education Agency to annually publish a list of board members who do not complete the annual training requirement in each noncompliant trustee's local newspaper. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the State Board of Education in SECTION 1 (Section 11.59, Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.159, Education Code, by adding Subsection (c), to require the regional education centers to report to the Texas Education Agency (TEA) and annually publish a list of independent school district trustees who have not completed the training required by the State Board of Education (SBOE). Requires the list to be published in a periodical or newspaper of general circulation in the community of each listed trustee during the anniversary week of the trustee election in the school district of the trustee. Requires the list to indicate the number of hours of training required to be completed and the number of hours of completed, for each trustee named. Requires SBOE to adopt rules necessary to implement this subsection. SECTION 2. Requires SBOE and TEA to conduct a review of the educational training requirements for independent school district trustees, including the content of the training and the number of required hours of training. Requires SBOE and TEA to report their findings to the legislature by January 5, 2005. SECTION 3. Effective date: September 1, 2003.
