SRC-TJG S.B. 1570 78(R) BILL ANALYSIS Senate Research Center S.B. 1570 By: Madla Natural Resources 4/17/2003 As Filed DIGEST AND PURPOSE The 77th Texas Legislature created the Trinity Glen Rose Groundwater Conservation District (district) to address critical, or future critical, water shortage in the area. The legislation also provided that under certain conditions, a public water supply well is exempt from regulation by the district and from payment of fees to the district. As proposed, S.B. 1570 clarifies the conditions for exemption by defining a completed well. This bill also requires the same level of completion for all capped wells that will subsequently be placed into service as part of a public water supply system to gain exemption. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Acts 2001, 77th Legislature, Chapter 1312, 2001 Texas General Laws 3222, by adding Subdivision (e) to clarify Subsection (a) (2) in accordance with the Texas Commission on Environmental Quality's technical requirements by defining the level of well installation and the deadline for completion required to qualify for exemption. SECTION 2. Provides that this Act prevails over another Act of the 78th Legislature, Regular Session, 2003, relating to nonsubstantive additions to and corrections in enacted codes, to the extent of any conflict. SECTION 3. Effective date: September 1, 2003.
