S.B. 1571 78(R) BILL ANALYSIS S.B. 1571 By: Carona Public Health Committee Report (Unamended) BACKGROUND AND PURPOSE Current Texas law provides the regulation standards for dental laboratories. With advancements in technology, particularly the advent of dental manufacturers, the need to update the regulation of dental laboratories has arisen. S.B. 1571 provides an exemption for a manufacturer of materials or component parts, used in the fabrication of a dental prosthetic appliance and for sale or use by a dental laboratory, that are not directly fitted to a dental model or cast of the human teeth, gums, jaws, or alveolar process. The bill also eliminates the requirement that in its application to the Dental Laboratory Certification Council a dental laboratory list the name and address of each dental technician employed by the laboratory. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Amends Section 266.002, Occupations Code, to provide that this chapter does not apply to a manufacturer of materials or component parts, used in the fabrication of a dental prosthetic appliance and for sale or use by a dental laboratory, that are not directly fitted to a dental model or cast of the human teeth, gums, jaws, or alveolar process. Amends Sections 266.102(c) and 266.152(a), Occupations Code, to delete "nationally" as a modifier for "recognized board of certification for dental technology." Amends Section 266.153(b), Occupations Code, to delete a current requirement in existing text relating to application requirements. Amends Section 266.201(b), Occupations Code, to delete the requirement that the prescription or work order contain the patient's address. EFFECTIVE DATE September 1, 2003
