SRC-TAG, EPT S.B. 1729 78(R) BILL ANALYSIS Senate Research Center S.B. 1729 By: Lindsay Natural Resources 4/1/2003 As Filed DIGEST AND PURPOSE Currently, Chapter 49 (Provisions Applicable to All Districts), Water Code fails to explain the compliance measures of storm water projects. Some district are concerned that complying with storm water management requirements would require competitive bidding. As proposed, S.B. 1729 clarifies that a water district may contract directly for services related to complying with construction storm water management regulations without receiving competitive bids. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 49.278(a), Water Code, to add services or contracts for services related to complying with any state or federal construction storm-water requirements, including obtaining permits and implementing any required best management practices, to the list of items to which this subchapter does not apply. SECTION 2. Effective date: upon passage or September 1, 2003.
