S.B. 1745 78(R) BILL ANALYSIS S.B. 1745 By: Zaffirini Criminal Jurisprudence Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, law enforcement agencies are not required to request an immediate forensic exam for victims who report an assault within a certain time of its occurrence. Senate Bill 1745 provides that a victim of an alleged sexual assault is entitled to a forensic medical examination if the alleged sexual assault was reported within 96 hours of its occurrence. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1745 amends the Code of Criminal Procedure to entitle a victim of sexual assault the right to a forensic medical examination, if the victim reported the sexual assault to a law enforcement agency within 96 hours of the assault. EFFECTIVE DATE September 1, 2003.
