SRC-TJG S.B. 1745 78(R) BILL ANALYSIS Senate Research Center S.B. 1745 By: Zaffirini Criminal Justice 4/22/2003 As Filed DIGEST AND PURPOSE Currently, law enforcement agencies are not required to request a forensic exam immediately for victims who report an assault within a certain time of its occurrence. As proposed, S.B. 1745 provides that a victim of an alleged sexual assault is entitled to a forensic medical examination if the alleged sexual assault was reported within 96 hours of its occurrence. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 56.02, Code of Criminal Procedure, by adding Subsection (e), to provide that a victim of an alleged sexual assault if [sic] entitled to a forensic medical examination if the alleged sexual assault was reported to law enforcement within 96 hours of its occurrence. SECTION 2. Effective date: September 1, 2003.
