C.S.S.B. 1765 78(R) BILL ANALYSIS C.S.S.B. 1765 By: Deuell Land & Resource Management Committee Report (Substituted) BACKGROUND AND PURPOSE Current law governs zoning around Lake Alan Henry, Lake Cooper, and Post Lake. C.S.S.B. 1765 adds Lake Ralph Hall to the list of areas subject to zoning under Chapter 231, Local Government Code. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends the heading to Subchapter G, Chapter 231, Local Government Code, to read as follows: SUBCHAPTER G. ZONING AROUND LAKE ALAN HENRY, LAKE COOPER, LAKE RALPH HALL, AND POST LAKE. SECTION 2. Amends Section 231.131(a), Local Government Code, to add Lake Ralph Hall to existing statute. SECTION 3. Amends Section 231.132, Local Government Code, as follows: Provides that this chapter applies to the area within 5,000 feet of where the shoreline of Lake Ralph Hall would be if the lake were filled to its storage capacity. Provides that the application of this law expires on September 1, 2013, unless the permit necessary for the construction of Lake Ralph Hall is issued before that date. SECTION 4. Effective date. EFFECTIVE DATE September 1, 2003, or immediately if it receives the requisite number of votes. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.S.B. 1765 adds a new provision providing that the application of this law expires on September 1, 2013, unless the permit necessary for the construction of Lake Ralph Hall is issued before that date.
