SRC-EPT S.B. 1790 78(R) BILL ANALYSIS Senate Research Center S.B. 1790 By: Lindsay Natural Resources 3/30/2003 As Filed DIGEST AND PURPOSE The increasing use of croaker as a bait fish used to catch the spotted sea trout has resulted in fewer croaker of an edible size. Some believe that the decrease of croaker in both size and population need to be addressed. As proposed, S.B. 1790 limits the possession of croaker to 10" or greater to prevent the use of croaker for bait. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 66C, Parks and Wildlife Code, by adding Section 66.207, as follows: Sec. 66.207. CROAKER AS LIVE BAIT. (a) Prohibits a person from engaging in fishing using for bait croaker that is less than 10 inches in length. Provides that a person who violates this section is subject to the penalty provided in Section 66.218. (b) Defines "croaker." SECTION 2. Effective date: September 1, 2003.
