SRC-AMY S.B. 1851 78(R) BILL ANALYSIS Senate Research Center S.B. 1851 By: Gallegos Education 4/15/2003 As Filed DIGEST AND PURPOSE Currently, Texas law allows a junior college district that contains a portion of a city, town, or village to annex the remainder of the particular political subdivision, but school districts are not included. In major metropolitan areas, residents in a portion of a large city may wish to join a junior college district, but it may not be feasible for the junior college to annex the entire remainder of the city. Additionally, some areas of the city may not want to join the junior college district. As proposed, S.B. 1851 allows a junior college district that is located within part of a school district, city, town, or village to annex territory, not necessarily the entire territory, included in those political subdivisions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 130.071, Education Code, as follows: Sec. 130.071. New heading: ANNEXATION OF POLITICAL SUBDIVISION TERRITORY BY CERTAIN DISTRICTS. (a) Authorizes a junior college district that is located within part of a school district, in addition to city, town, or village, to annex territory, rather than the territory, included within the school district, in addition to city, town, or village, in accordance with this section. (b) - (j) No changes made to these subsections. (k) Makes conforming changes. (l) No changes made to this subsection. SECTION 2. Effective date: upon passage or September 1, 2003.
