SRC-JLB S.B. 1877 78(R) BILL ANALYSIS Senate Research Center S.B. 1877 78R3191 RCJ-DBy: Madla Natural Resources 3/25/2003 As Filed DIGEST AND PURPOSE Currently, elections for the directors of the Real-Edwards Conservation and Reclamation District (district) are held on the first Saturday of May. As proposed, S.B. 1877 moves the election date for the directors of the district from the first Saturday in May to the first Tuesday after the first Monday in November. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11(b), Chapter 341, Acts of the 56th Legislature, Regular Session, 1959, to require elections to be held in the Real-Edwards Conservation and Reclamation District (district) on the first Tuesday after the first Monday in November, rather than the first Saturday of May, in each even-numbered year. SECTION 2. Provides that certain actions of the district are validated and confirmed as if they had been done as authorized by law. SECTION 3. (a) Requires a member of the board of directors of the district serving on the effective date of this Act to continue in office until the member's successor, elected at the election held November 2, 2004, qualifies for office. (b) Requires nine directors, at the election held November 2, 2004, to be elected to the board. Requires the nine directors elected to draw lots to determine which four directors serve two-year terms and which five directors serve four-year terms beginning January 1 following the election. (c) Provides that directors elected at the election held November 7, 2006, and in successive even-numbered years as provided by Section 11, Chapter 341, Acts of the 56th Legislature, Regular Session, 1959, as amended by this Act, serve four-year terms beginning January 1 following the election. SECTION 4. Effective date: upon passage or September 1, 2003.
