BACKGROUND AND PURPOSE 

The Westchase Area Management District includes a board of directors whose
members are required to hold positions in office, retail, land, and
similar categories.  Because of changes in the real estate market, at
times, the board has trouble finding qualified members to fill board
positions.   As proposed, S.B. 1887 would change the qualifications for
board members, allowing interested parties to fill positions while keeping
an overall representation of the area.  In addition, the bill would grant
the district the power to provide for convention centers. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 376.050, Local Government Code, concerning the
appointment of directors, to allow the mayor and members of the governing
body to consider for appointment persons representing the named interests,
and remove the requirements that certain persons represent specific
interests be named to specific positions on the board; in addition the
20,000 or more square feet requirement for the category of owners of
multitenant retail property or major retail tenants is removed. 

SECTION 2.  Amends Subchapter B, Chapter 376, Local Government Code, by
adding Section Section 376.066 to allow the district to finance, acquire,
lease, construct, improve, operate or maintain conference and convocation
centers in the district, with the power to enter into longterm operating
agreements. 

SECTION 3.  Validation clause.

SECTION 4.  Effective date.

EFFECTIVE DATE:  Upon passage, or, if the Act does not receive the
necessary vote, the Act takes effect September 1, 2003. 

COMPARISON OF SUBSTITUTE TO ORIGINAL

The substitute makes non-substantive language changes to the original in
SECTION 1; removes language allowing the district to solicit, market, or
promote telecommunications services, and recodifies the original's
language regarding the district's power to finance, acquire, lease,
construct, improve, operate or maintain conference and convocation centers
into a new section in the Local Government Code.
