SRC-JLB S.B. 1899 78(R) BILL ANALYSIS Senate Research Center S.B. 1899 78R10491 RCJ-DBy: Staples Natural Resources 4/25/2003 As Filed DIGEST AND PURPOSE Currently, the Pineywoods Groundwater Conservation District (district) is authorized to adopt rules requiring a permit to transport groundwater out of the district. However, the original Act creating the district contains an exception to the requirement, which goes beyond provisions set forth in the Water Code. As proposed, S.B. 1899 removes the exception to make the rulemaking and regulatory authority consistent with the Water Code. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 5(b), Chapter 1330, Acts of the 77th Legislature, Regular Session, 2001, to delete text that provides that a retail public utility is not required to obtain a permit to transfer ground water out of a district if certain conditions exist. SECTION 2. Effective date: upon passage or September 1, 2003.
