SRC-JLB S.B. 1900 78(R) BILL ANALYSIS Senate Research Center S.B. 1900 78R10492 RCJ-DBy: Staples Natural Resources 4/25/2003 As Filed DIGEST AND PURPOSE The Neches and Trinity Valleys Groundwater Conservation District (district) is authorized to adopt rules requiring a permit to transport groundwater out of the district. The original Act creating the district contains an exception to the requirement which goes beyond provisions in the Water Code. As proposed, S.B. 1900 remove the exception to make the rule making and regulatory authority consistent with the Water Code. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 5(b), Chapter 1387, Acts of the 77th Legislature, Regular Session, 2001, to delete text authorizing the Neches and Trinity Valleys Groundwater Conservation District (district) to determine that a transfer of groundwater produced within the district's boundaries for use outside the district's boundaries will not be considered a transfer outside the district if certain conditions exist. SECTION 2. Effective date: upon passage or September 1, 2003.
