S.B. 1923 78(R) BILL ANALYSIS

S.B. 1923
By: Ogden
Judicial Affairs
Committee Report (Unamended)

BACKGROUND AND PURPOSE

Under current law, district attorneys may maintain an independent law
practice to supplement their pay unless their office is listed in the
Professional Prosecutors Act, which provides additional state funding to
supplement existing salaries in exchange for prohibiting the prosecutor
from the private practice of law.

S.B. 1923 adds the district attorney for the 258th Judicial District to
those district attorneys subject to the professional prosecutors law.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution.

ANALYSIS

S.B. 1923 amends the Government Code to add the district attorney from the
258th Judicial District to the list of prosecutors who are subject to the
professional prosecutors law.

EFFECTIVE DATE

January 1, 2005.
