SRC-LBB S.B. 1923 78(R)BILL ANALYSIS Senate Research CenterS.B. 1923 By: Ogden Jurisprudence 5/8/2003 Committee Report (Amended) DIGEST AND PURPOSE Chapter 46 of the Government Code applies to prosecuting attorneys in the counties and judicial districts enumerated in the statute. The statute contains provisions specifying the salaries and expenses for covered state prosecutors. It also prohibits covered state prosecutors from engaging in the private practice of law. S.B. 1923 adds the Trinity County District Attorney to the list of prosecutors governed by the Professional Prosecutors Act. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002, Government Code, to include the district attorney for the 258th Judicial District in the list of prosecutors governed by the Professional Prosecutors Act. SECTION 2. Effective date: January 1, 2004. Makes application of this Act prospective. LIST OF COMMITTEE AMENDMENTS Amend S.B. No. 1923 by striking SECTION 2 of the bill and substituting, "SECTION 2. This Act takes effect January 1, 2005.
