SRC-TJG S.B. 1928 78(R)BILL ANALYSIS Senate Research CenterS.B. 1928 By: Staples Natural Resources 7/8/2003 Enrolled DIGEST AND PURPOSE The Athens Municipal Water Authority (authority) was created to serve the City of Athens. Since the authority's inception the City of Athens has grown tremendously, yet the special laws creating the district have not been updated to include all of the annexed territory of the City of Athens. S. B. 1928 validates the expansion of the Athens Municipal Water Authority's district to include all areas previously annexed by the City of Athens so that the authority serves all areas included in the City of Athens. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 2(a) and (b), Chapter 142, Acts of the 55th Legislature, Regular Session, 1957, as follows: (a) Requires the Athens Municipal Water Authority (authority) to be in Henderson County, Texas, and embrace, subject to annexations of territory as provided by this section, Section 5 of this Act, and Chapter 49, Water Code (Provisions Applicable to All Districts), all of the territory which is, rather than was, contained within the corporate limits of the City of Athens, Henderson County, Texas, on September 1, 2003, rather than the 2nd day of May, 1957. Deletes existing text relating to considerations of territory annexed to the City of Athens subsequent to the 2nd day of May, 1957. (b) Makes a conforming change. SECTION 2. (a) Provides that all actions and proceedings taken before the effective date of this Act in annexing territory to the authority are validated and that territory is declared to constitute a part of the district. Provides that all acts of the board of directors of the district in redefining the boundaries of the district and the redefined boundaries are validated. (b) Provides that the validation provisions of Subsection (a) of this section do not apply to any annexation or redefinition of boundaries that meet certain conditions on the effective date of this Act. SECTION 3. Effective date: September 1, 2003.
