DIGEST AND PURPOSE 

Currently, the board of directors of the Brazos River Authority has
twenty-one members.  As proposed, S.B. 1931 reduces the number of members
of the board from twenty-one to nine.  This bill also requires the
governor to designate a member of the board as chair and appoint the nine
members of the board as soon as practicable after the effective date of
the bill. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 6, Chapter 13, Special Laws, Acts of the 41st
Legislature, 2nd Called Session, 1929, by requiring the board of directors
of the Brazos County River Authority (board) to have nine, rather than
twenty-one, members.  Requires members of the board and their successors
to serve for a tem of six years and until  their successors are designated
and qualified. Provides that on February 1, of each odd-numbered year, the
terms of three, rather than seven, members of the board expire.  Requires
five, rather than seven, members to constitute a quorum to transact
business.  Requires the governor to designate a member of the board as
presiding officer of the board to serve in that capacity at the pleasure
of the governor.  Deletes existing text relating to requiring the persons
serving on the board on the effective date of this amendment to continue
to serve for their unexpired terms.  Deletes existing text relating to
requiring the board to elect one of their members as chairman.  Makes
conforming and nonsubstantive changes. 

SECTION 2.  Requires the governor, as soon as practicable on or after the
effective date of this Act, to appoint nine directors as provided by
Section 6, Chapter 13, Special Laws, Acts of the 41st Legislature, 2nd
Called Session, 1929, as amended by this Act.  Requires the governor to
appoint three of the directors to terms expiring on February 1, 2005,
three to terms expiring February 1, 2007, and three to terms expiring
February 1, 2009.  Provides that the position of a member of the board
serving immediately before the effective date of this At is abolished at
the time five or more of the newly appointed directors qualify for office.
Makes application of this Act prospective. 

SECTION 3.  Effective date: September 1, 2003.
