DIGEST AND PURPOSE 

The district attorney position in Trinity County is currently vacant.
S.B. 1932 allows an attorney employed by the Prison Prosecution Unit to
fill the vacant position of district attorney only until the position is
filled by the governor or by the voters of the district in an election.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 43.171, Government Code, by adding Subsection
(c), to require an attorney who is employed by the prison prosecution unit
to perform the duties of the district attorney if there is a vacancy in
the office of district attorney serving the county.  Requires the attorney
who is employed by the prison prosecution unit to perform the duties of
district attorney only until the vacancy in the county's office of
district attorney is filled by the governor or a district attorney is
elected by the voters of the district.  Specifies that the duties under
this subsection are in addition to the duties of the prosecution unit and
the attorney employed by the prison prosecution unit.  Establishes that
the prison prosecution unit and the attorney employed by the prison
prosecution unit are not entitled to additional compensation or
reimbursement.  Provides that this section expires February 1, 2005. 
 
SECTION 2.  Effective date: upon passage or September 1, 2003.
