S.B. 1932 78(R) BILL ANALYSIS S.B. 1932 By: Ogden Judicial Affairs Committee Report (Amended) BACKGROUND AND PURPOSE The district attorney position in Trinity County is currently vacant. S.B. 1932 allows an attorney employed by the Prison Prosecution Unit to fill the vacant position of district attorney only until the position is filled by the governor or by the voters of the district in an election. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS S.B. 1932 provides that an attorney who is employed by the prison prosecution unit shall perform the duties of the district attorney if there is a vacancy in the office of district attorney serving the county. The bill requires the attorney who is employed by the prison prosecution unit to perform the duties of district attorney only until the vacancy in the county's office of district attorney is filled by the governor or a district attorney is elected by the voters of the district. This section expires February 1, 2005. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect on September 1, 2003. EXPLANATION OF AMENDMENTS Committee Amendment No. 1 provides that "the duties under this subsection are in addition to the duties of the prison prosecution unit and the attorney employed by the prison prosecution unit. The prison prosecution unit and the attorney employed by the prison prosecution unit are not entitled to additional compensation or reimbursement."
