SRC-JEC S.J.R. 3 78(R) BILL ANALYSIS Senate Research Center S.J.R. 3 By: West, Royce Criminal Justice 5/10/2003 As Filed DIGEST AND PURPOSE S.J.R. 3 proposes a constitutional amendment authorizing the governor to grant pardons to persons who have received deferred adjudication. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subsection (b), Section 11, Article IV, Texas Constitution, to grant the governor the power, in all criminal cases, except treason and impeachment, after order of deferred adjudication, to grant reprieves and commutations of punishment and pardons. SECTION 2. Requires this proposed constitutional amendment to be submitted to the voters at an election to be held November 4, 2003. Sets forth the required text of the ballot.
