SRC-LBB S.J.R. 4 78(R) BILL ANALYSIS Senate Research Center S.J.R. 4 78R16651 AJA-DBy: Ratliff State Affairs 5/17/2003 As Filed DIGEST AND PURPOSE S.J.R. 4 proposes a constitutional amendment to permit the legislature to require the sale of certain land dedicated to the permanent school fund. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article VII, Texas Constitution, by adding Section 2C, as follows: Sec. 2C. (a) Authorizes the legislature to direct the School Land Board to approve a patent to release all of the state's interest in the land described by Subsection (b) of this section, excluding mineral rights, to a person holding the land under a contract for deed with the Veterans' Land Board on January 1, 1964, or an heir or assign of that person, in exchange for consideration in an amount determined by the School Land Board in consultation with the Veterans' Land Board. (b) Provides that this section applies to a certain tract of land. (c) Provides that this section expires January 1, 2006. SECTION 2. Requires this proposed constitutional amendment to be submitted to the voters at an election to be held November 4, 2003. Requires the ballot to be printed to permit voting for or against the proposition: "The constitutional amendment to permit the legislature to require the sale of certain land dedicated to the permanent school fund."
