SRC-TAG, MLC, TAG S.J.R. 10 78(R) BILL ANALYSIS Senate Research Center S.J.R. 10 78R2977 RCJ-DBy: Janek Finance 4/15/2003 As Filed DIGEST AND PURPOSE As proposed, S.J.R. 10 proposes a constitutional amendment to place a 10 percent cap on the maximum average annual increase of the appraised value of homestead. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 1(i), Article VIII, Texas Constitution, to authorize the legislature by general law to limit the maximum average annual percentage increase in the appraised value of residence homesteads for ad valorem tax purposes to 10 percent or a lesser, rather than greater, percentage for each year since the most recent tax appraisal, notwithstanding Subsections (a) and (b) of this section. SECTION 2. Requires this proposed constitutional amendment to be submitted to the voters at an election held on November 4, 2003. Requires the ballot to be printed to permit voting for or against the proposition: "The constitutional amendment to authorize the legislature to set a limit of less than 10 percent on annual increases in the appraised value of a residence homestead for ad valorem tax purposes."
