A BILL TO BE ENTITLED
AN ACT
relating to the development and implementation of school district indoor air quality programs. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 38, Education Code, is amended by adding Section 38.016 to read as follows: Sec. 38.016. INDOOR AIR QUALITY PROGRAM. (a) A school district shall develop and implement an indoor air quality program that addresses indoor air quality at each facility used by the district primarily for the instruction of students. (b) A school district shall appoint a coordinator to manage the program and shall provide appropriate support staff to assist the coordinator. (c) The program must include: (1) assessment of indoor air quality, including annual inspection and review of district facilities; (2) development of standards and goals for indoor air quality; (3) a maintenance and operation plan, including an implementation schedule; (4) a management plan, including provisions regarding recordkeeping; (5) procedures for establishing a budget and identifying sources of funding for the program; (6) procedures for training district employees regarding the program; (7) procedures for communicating with parents, students, and district employees regarding the program and indoor air quality; (8) an annual review of the program by the board of trustees in a public meeting with public participation; and (9) a complaint process available to members of the public and district employees. (d) In developing standards and goals as required by Subsection (c)(2), a school district shall consider any relevant guidelines established by the Texas Board of Health under Chapter 385, Health and Safety Code. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
