A BILL TO BE ENTITLED

AN ACT

relating to the use of electronic textbooks in public schools.                
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter A, Chapter 31, Education Code, is 
amended by adding Section 31.004 to read as follows:
	Sec. 31.004.  ELECTRONIC TEXTBOOKS REQUIRED.  (a)  At least 
95 percent of the textbooks in use in public schools and purchased 
with money from the state textbook fund must be electronic 
textbooks.
	(b)  This section does not apply to textbooks purchased under 
Section 31.028.
	(c)  Subsection (a) applies beginning with the 2007-2008 
school year.  Not later than the 2005-2006 school year, at least 50 
percent of the textbooks in use in public schools and purchased with 
money from the state textbook fund must be electronic textbooks.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
