A BILL TO BE ENTITLED
AN ACT
relating to allowing a veteran to remove from the county clerk's possession all copies of a military discharge record the veteran has recorded with the county clerk. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 192.002, Local Government Code, is amended by adding Subsection (c) to read as follows: (c) The veteran who is the subject of a military discharge record recorded under this section or the legal guardian of the veteran may direct the county clerk to destroy or deliver to the veteran or the veteran's legal guardian all copies of the record. The county clerk shall comply with the direction, and the county clerk's compliance does not violate any law of this state relating to the preservation, destruction, or alienation of public records. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
