A BILL TO BE ENTITLED
AN ACT
relating to an open enrollment for certain participants in the Texas Public School Retired Employees Group Insurance Program. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. OPEN ENROLLMENT PERIOD REQUIRED. (a) The Teacher Retirement System of Texas, as trustee of the Texas Public School Retired Employees Group Insurance Program, shall offer an open enrollment period for participants in the program. (b) The open enrollment period required by this Act must: (1) begin not later than December 1, 2003; (2) be at least 30 days in length; and (3) consist of an entire calendar month. (c) Each retiree, surviving spouse, or surviving dependent child eligible to be enrolled in the program under the Texas Public School Retired Employees Group Insurance Act (Article 3.50-4, Vernon's Texas Insurance Code) or Chapter 1575, Insurance Code, before the first day of the open enrollment period may participate in the open enrollment period. (d) During the open enrollment period required by this Act, an individual eligible to participate in the open enrollment period under Subsection (c) of this section may: (1) enroll in the program; (2) enroll new or different dependents in the program; (3) select different or additional coverage available under the program; and (4) make other elections as authorized by the Teacher Retirement System of Texas. SECTION 2. EFFECTIVE DATE. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003. SECTION 3. EXPIRATION. This Act expires January 1, 2004.
