A BILL TO BE ENTITLED
AN ACT
relating to the amount of hazardous duty pay for certain state employees. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 659.062, Government Code, is amended by amending Subsection (a) and adding Subsection (f) to read as follows: (a) An eligible employee is entitled to monthly hazardous duty pay based on the number of years [of $7 a month for each year] of service as an employee of this state in a position that requires the performance of hazardous duty[, not to exceed 30 years of such service]. An eligible employee is entitled to hazardous duty pay according to the following schedule: (1) employees who have less than five years of state hazardous duty service are entitled to hazardous duty pay of $10 a month; (2) employees who have at least 5 years but less than 10 years of state hazardous duty service are entitled to hazardous duty pay of $15 a month; (3) employees who have at least 10 years but less than 15 years of state hazardous duty service are entitled to hazardous duty pay of $20 a month; and (4) employees who have 15 or more years of state hazardous duty service are entitled to hazardous duty pay of $25 a month [Except as provided by Subsection (c) or Section 659.063(b)(1), this hazardous duty pay is instead of other hazardous duty or longevity pay]. (f) Except as provided by Subsection (c) or Section 659.063(b)(1), the hazardous duty pay provided by this section is instead of other hazardous duty or longevity pay. SECTION 2. This Act takes effect September 1, 2003.
