A BILL TO BE ENTITLED

AN ACT

relating to excluding certain nursing institutions from the 
requirement to maintain liability insurance coverage for health 
care liability claims.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 242.0372, Health and Safety Code, as 
effective September 1, 2003, is amended by adding Subsection (f) to 
read as follows:
	(f)  This section does not apply to an institution that is:             
		(1)  the only licensed institution located within a 
county that has a population of less than 50,000; and
		(2)  owned, controlled, and operated by a nonprofit 
corporation organized under the Texas Non-Profit Corporation Act 
(Article 1396-1.01 et seq., Vernon's Texas Civil Statutes).
	SECTION 2.  This Act takes effect September 1, 2003.
