A BILL TO BE ENTITLED
AN ACT
relating to the assessment of certain court costs in justice courts. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Article 102.009, Code of Criminal Procedure, is amended to read as follows: Art. 102.009. COURT COSTS FOR MISDEMEANOR CONVICTIONS IN JUSTICE COURTS [CERTAIN COUNTIES]. In each county [counties with a population of 3.3 million or more], the commissioners court shall [may] set court costs in the amount of $7 for each conviction for persons convicted of a Class C misdemeanor in the justice courts. [Court costs set as provided by this article may not exceed $7 for each conviction.] SECTION 2. (a) This Act takes effect September 1, 2003. (b) The change in law made by this Act applies only to an offense committed on or after September 1, 2003. An offense committed before September 1, 2003, is covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. For the purposes of this subsection, an offense was committed before September 1, 2003, if any element of the offense occurred before that date.
