A BILL TO BE ENTITLED
AN ACT
relating to the members of the Texas Transportation Commission.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Sections 201.051(a) and (c), Transportation
Code, are amended to read as follows:
(a) The Texas Transportation Commission consists of five
[three] members appointed by the governor with the advice and
consent of the senate.
(c) Appointments to the commission shall be made so that
each geographic area of the state is represented on the commission.
Each member of the commission must represent the general public.
SECTION 2. Section 201.052, Transportation Code, is amended
to read as follows:
Sec. 201.052. TERMS. Members of the commission serve
staggered six-year terms, with the terms of either one or two
members [one member's term] expiring February 1 of each
odd-numbered year in accordance with Section 30a, Article XVI,
Texas Constitution.
SECTION 3. Promptly after this Act takes effect, the
governor shall appoint two additional members to the Texas
Transportation Commission. Of those members, the governor shall
appoint one to serve a term expiring February 1, 2005, and one to
serve a term expiring February 1, 2007.
SECTION 4. The changes in law made by this Act in the
qualifications of members of the Texas Transportation Commission do
not affect the entitlement of a member serving on the commission
immediately before the effective date of this Act to continue to
carry out the commission's functions for the remainder of the
member's term. The changes in law apply only to a member appointed
on or after the effective date of this Act. This Act does not
prohibit a person who is a member of the commission on the effective
date of this Act from being reappointed to the commission if the
person has the qualifications required for a member under Section
201.051, Transportation Code, as amended by this Act.
SECTION 5. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
