A BILL TO BE ENTITLED
AN ACT
relating to the eligibility of a student to transfer to a different
school under the No Child Left Behind Act.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 25, Education Code, is
amended by adding Section 25.043 to read as follows:
Sec. 25.043. TRANSFERS UNDER FEDERAL LAW. In addition to
any other transfer authorized under this subchapter or Subchapter
G, Chapter 29, a student may transfer to another school in the
school district in which the student is entitled to attend school
under Section 25.001 if the student is assigned to attend a school
from which a student may transfer under the No Child Left Behind Act
of 2001 (Pub.L. No. 107-110) and any related rules adopted by the
commissioner.
SECTION 2. This Act applies beginning with the 2003-2004
school year.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
