A BILL TO BE ENTITLED
AN ACT
relating to the powers of the executive director of the Office of
Rural Community Affairs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 487, Government Code, is
amended by adding Section 487.0265 to read as follows:
Sec. 487.0265. GENERAL POWERS OF EXECUTIVE DIRECTOR;
SUPERVISION BY EXECUTIVE COMMITTEE. (a) The executive committee
shall supervise the exercise of the executive director's powers
under this section.
(b) The executive director may make an expenditure, enter
into a contract, require a report, conduct an investigation, or
take any other action the executive director or executive committee
considers necessary or suitable to fulfill the office's duties.
(c) The executive director may enter into an interagency
contract or a memorandum of understanding with another state agency
to perform an administrative function of the office.
(d) The executive director shall determine the organization
and procedures of the office.
(e) The executive director may:
(1) employ and terminate the employment of office
staff members within guidelines established by the executive
committee; and
(2) require a bond for any person that handles money or
signs checks under this chapter.
SECTION 2. Section 487.026(c), Government Code, is
repealed.
SECTION 3. This Act takes effect September 1, 2003.
