A BILL TO BE ENTITLED
AN ACT
relating to the membership of the board of directors of the Texas Underground Facility Notification Corporation. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 251.055(a), Utilities Code, is amended to read as follows: (a) The board of directors of the corporation is composed of the following 14 [12] members appointed by the governor: (1) six representatives of the general public; (2) one representative of the gas industry; (3) one representative of the telecommunications industry; (4) one representative of the electric industry; (5) one representative of cable television companies; (6) one representative of municipalities; [and] (7) one representative of persons who engage in excavation operations who are not also facility operators; (8) one representative of the Public Utility Commission of Texas; and (9) one representative of the Railroad Commission of Texas. SECTION 2. Section 251.056(a), Utilities Code, is amended to read as follows: (a) Directors serve staggered three-year terms, with the terms of four or five directors expiring each August 31. SECTION 3. As soon as possible after the effective date of this Act, the governor shall appoint: (1) a representative of the Public Utility Commission of Texas to the Texas Underground Facility Notification Corporation for a term expiring August 31, 2006; and (2) a representative of the Railroad Commission of Texas to the Texas Underground Facility Notification Corporation for a term expiring August 31, 2005. SECTION 4. This Act takes effect September 1, 2003.
