A BILL TO BE ENTITLED
AN ACT
relating to enforcement of requirements relating to the filing of
certain financial statements and campaign finance reports.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 572, Government Code, is
amended by adding Section 572.035 to read as follows:
Sec. 572.035. ACTION TO REQUIRE COMPLIANCE. (a) A resident
of this state may bring an action for injunctive or other
appropriate relief against an individual to require the individual
to file a financial statement under this subchapter that the
individual has failed to timely file.
(b) The court shall award a plaintiff who prevails in an
action under this section reasonable attorney's fees and court
costs.
SECTION 2. Subchapter B, Chapter 254, Election Code, is
amended by adding Section 254.043 to read as follows:
Sec. 254.043. ACTION TO REQUIRE COMPLIANCE. (a) A resident
of this state may bring an action for injunctive or other
appropriate relief against a person to require the person to file a
report under this chapter that the person has failed to timely file.
(b) The court shall award a plaintiff who prevails in an
action under this section reasonable attorney's fees and court
costs.
SECTION 3. This Act applies only to an action that is
commenced on or after the effective date of this Act. An action
that is commenced before the effective date of this Act is governed
by the law applicable to the action immediately before the
effective date of this Act, and that law is continued in effect for
that purpose.
SECTION 4. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
