A BILL TO BE ENTITLED

AN ACT

relating to the definition of "sexual contact" for purposes of 
certain sex offenses.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 43.01(3), Penal Code, is amended to read 
as follows:     
		(3)  "Sexual contact" means any touching of the anus, 
breast, or any part of the genitals of any [another] person with 
intent to arouse or gratify the sexual desire of any person.
	SECTION 2.  (a) This Act takes effect September 1, 2003.                       
	(b)  The change in law made by this Act applies only to an 
offense committed on or after September 1, 2003. An offense 
committed before September 1, 2003, is covered by the law in effect 
when the offense was committed, and the former law is continued in 
effect for that purpose.  For purposes of this subsection, an 
offense was committed before September 1, 2003, if any element of 
the offense was committed before that date.
