                                                                  H.B. No. 1046




AN ACT

relating to an application for registration of a commercial 
fertilizer.     
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Sections 63.032(b) and (c), Agriculture Code, 
are amended to read as follows:
	(b)  [If the home office or the principal place of business 
of the person applying for registration is located outside this 
state, the application must be accompanied by a written instrument 
appointing a resident agent for service of legal process.
	[(c)]  The service may prescribe and furnish forms for 
registration of commercial fertilizers under this chapter.  The 
service shall provide a registrant with a copy of the approved 
registration.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
