A BILL TO BE ENTITLED
AN ACT
relating to the employment of a minor in certain establishments that serve alcoholic beverages. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 106.09, Alcoholic Beverage Code, is amended by amending Subsections (a) and (c) and adding Subsection (e) to read as follows: (a) Except as provided in Subsections (b), [and] (c), and (e) of this section, no person may employ a person under 18 years of age to sell, prepare, serve, or otherwise handle liquor, or to assist in doing so. (c) A holder of a [mixed beverage] permit or license providing for the on-premises consumption of alcoholic beverages may employ a person under 18 years of age to work in any capacity other than the actual selling, preparing, or serving of alcoholic [mixed] beverages. (e) The holder of a permit or license providing for the on-premises consumption of alcoholic beverages who also holds a food and beverage certificate may employ a person under 18 years of age to work as a cashier for transactions involving the sale of alcoholic beverages if the alcoholic beverages are served by a person 18 years of age or older. SECTION 2. (a) This Act takes effect September 1, 2003. (b) The change in law made by this Act to Section 106.09, Alcoholic Beverage Code, applies only to an offense committed on or after the effective date of this Act. An offense committed before the effective date of this Act is covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. For purposes of this section, an offense was committed before the effective date of this Act if any element of the offense occurred before that date.
