A BILL TO BE ENTITLED
AN ACT
relating to the eligibility requirements to serve as a director of a groundwater conservation district. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 36.051, Water Code, is amended by adding Subsection (d) to read as follows: (d) In a district with a population of less than 50,000, the common law doctrine of incompatibility does not disqualify: (1) an officer or employee of a political subdivision from serving as a director of the district; or (2) a director of the district from serving as a director, officer, or employee of a political subdivision. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
