A BILL TO BE ENTITLED
AN ACT
relating to the ownership of a motor vehicle dealership. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Article 2301.476, Occupations Code, is amended by adding Subsection (h) to read as follows: (h) A manufacturer may own an interest in a dealer which is a person or entity engaged in the business of renting passenger and commercial motor vehicles, as well as activities incidental to the rental business, if the motor vehicles sold by the person or entity are limited to: (1) Motor vehicles that have been used exclusively and regularly by the person or entity in the conduct of its rental business; and (2) Used motor vehicles traded in on motor vehicles sold by the person or entity. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect June 1, 2003. SECTION 3. The importance of this legislation and the crowded condition of the calendars in both houses create an emergency and an imperative public necessity that the constitutional rule requiring bills to be read on three several days in each house be suspended, and this rule is hereby suspended.
