A BILL TO BE ENTITLED
AN ACT
relating to nonrenewal of certain public school teacher contracts. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter E, Chapter 21, Education Code, is amended by adding Section 21.2061 to read as follows: Sec. 21.2061. NONRENEWAL IN BEST INTEREST OF STUDENTS. (a) The board of trustees may choose to not renew a teacher's contract if the principal of the school to which the teacher is assigned determines that nonrenewal is in the best interest of the school's students. (b) Sections 21.206 and 21.207 do not apply if the board of trustees chooses to not renew a teacher's contract in accordance with this section. (c) Notwithstanding Section 21.209 or any other provision of this chapter, the decision of the board of trustees to not renew a teacher's contract in accordance with this section is final and may not be appealed. SECTION 2. Section 21.2061, Education Code, as added by this Act, applies only to a contract nonrenewal that occurs on or after September 1, 2003. A contract nonrenewal that occurs before September 1, 2003, is governed by the law in effect on the date that the nonrenewal occurs, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2003.
