A BILL TO BE ENTITLED

AN ACT

relating to parity in the regulation of tobacco products among 
on-premise alcoholic beverage license and permit holders.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 109.57(a) of the Alcoholic Beverage Code 
is amended to read as follows:
	(a)  Except as is expressly authorized by this code, a 
regulation, charter, or ordinance promulgated by a governmental 
entity of this state may not impose stricter standards on premises 
or businesses required to have a license or permit under this code 
than are imposed on similar premises or businesses that are not 
required to have such a license or permit.  Nor may a governmental 
entity of this state regulate tobacco use in a manner which 
differentiates between businesses required to have a license or 
permit for the on-premise sale or service of alcohol under this 
code.
	SECTION 2.  This Act takes effect September 1, 2003.
