A BILL TO BE ENTITLED
AN ACT
relating to the use of site-specific information by a groundwater
conservation district to develop its management plan.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 36.1071, Water Code, is amended by
amending Subsection (h) and adding Subsection (i) to read as
follows:
(h) In developing its management plan, the district shall
use the groundwater availability modeling information provided by
the executive administrator in conjunction with any available
site-specific information provided by the district [and acceptable
to the executive administrator].
(i) If the district anticipates using site-specific
information, not later than the 60th day before the date of the
public hearing at which adoption of the management plan is first
considered, the district shall submit the site-specific
information to the executive administrator for review and comment.
The executive administrator shall provide comments to the district
in a timely manner so that the comments are available for
consideration at the public hearing. The district shall consider
the comments received from the executive administrator and may
revise the management plan accordingly before it is adopted.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
