A BILL TO BE ENTITLED

AN ACT

relating to risk management services for employees of community 
supervision and corrections departments.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 412.011, Labor Code, is amended by 
adding  Subsection (f) to read as follows:
	(f)  In this subsection, "employee of a community 
supervision and corrections department" means an employee of a 
department established under Chapter 76, Government Code.  For 
purposes of performing risk management under Subsections (b)(1) and 
(c), an  employee of a community supervision and corrections 
department is considered to be an employee of the Texas Department 
of Criminal Justice.
	SECTION 2.  Section 76.006(c), Government Code, is amended 
to read as follows:
	(c)  Department employees are state employees for the 
purposes of Chapter 104, Civil Practice and Remedies Code, and 
Chapter 501, Labor Code.  A department employee is considered to be 
an employee of the Texas Department of Criminal Justice for 
purposes of risk management under Chapter 412, Labor Code.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
