A BILL TO BE ENTITLED
AN ACT
relating to a prohibition of expansion of managed care delivery
systems under the state Medicaid program.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 533, Government Code, is
amended by adding Section 533.019 to read as follows:
Sec. 533.019. PROHIBITION ON EXPANSION OF MEDICAID MANAGED
DELIVERY SYSTEMS. Notwithstanding any other law, the commission
may not:
(1) implement additional Medicaid managed care pilot
programs, Medicaid behavioral health pilot programs, or Medicaid
Star + Plus pilot programs; or
(2) otherwise expand the use of managed care delivery
systems under the Medicaid program in this state.
SECTION 2. Section 533.019, Government Code, as added by
this Act, does not affect the authority of the Health and Human
Services Commission or a health and human services agency to
administer a pilot program or other managed care delivery system
that is in operation on the effective date of this Act.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
