A BILL TO BE ENTITLED

AN ACT

relating to a restrictive covenant prohibiting a homeowner from 
displaying the United States flag or the Texas flag.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 202, Property Code, is amended to add 
Section 202.007 to read as follows:
	Sec. 202.007.  CERTAIN RESTRICTIVE COVENANTS PROHIBITED.  A 
restrictive covenant may not prohibit a property owner from 
displaying the United States flag or the Texas flag in a respectful 
manner on the owner's property on a flag pole that is 18 feet tall or 
shorter.
	SECTION 2.  This Act takes effect September 1, 2003, and 
applies only to a restrictive covenant adopted on or after that 
date.  A restrictive covenant adopted before the effective date of 
this Act is governed by the law in effect immediately before that 
date, and that law is continued in effect for that purpose.
