A BILL TO BE ENTITLED

AN ACT

relating to the sale of land by the Parks and Wildlife Department             
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter A, Chapter 13, Parks and Wildlife 
Code, is amended by adding Section 13.0091, to read as follows:
	Sec. 13.0091.  OFFER TO LOCAL ENTITY.  (a) Notwithstanding 
any other provision of law, prior to the sale of land by the 
department the Commission shall offer to transfer the land to the 
county in which the land is located on the following conditions:
		(1)  the county expresses interest in development of 
the land for public use; and
		(2)  the land to be transferred shall continue to be 
dedicated park land and used for park purposes.
	(b)  Upon an affirmative vote by the commissioners court of 
the county to accept the Commission's offer of transfer, the 
Commission shall instruct the department to transfer the land to 
the county at no expense to the county.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If it does 
not receive the vote necessary for immediate effect, this Act takes 
effect September 1, 2003.
