A BILL TO BE ENTITLED
AN ACT
relating to the regulation of talent agencies. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 2105.002(b), Occupations Code, is amended to read as follows: (b) The department may: (1) adopt rules as necessary to administer the registration program created under this chapter; [and] (2) audit or examine the books and records, including an account maintained under Section 2105.105, of a certificate holder or an applicant for a certificate of registration; and (3) take other action as necessary to enforce this chapter. SECTION 2. Section 2105.052(c), Occupations Code, is amended to read as follows: (c) A registration statement must be accompanied by a surety bond in the amount of $100,000 [$10,000] that is: (1) payable to the state; and (2) conditioned on faithful compliance with this chapter. SECTION 3. Section 2105.055(b), Occupations Code, is repealed. SECTION 4. (a) This Act takes effect September 1, 2003. (b) The change in law made by this Act by the amendment of Section 2105.052(c), Occupations Code, applies only to an application for a certificate of registration filed with the Texas Department of Licensing and Regulation on or after the effective date of this Act. An application for a certificate of registration filed before the effective date of this Act is governed by the law in effect on the date the application was filed, and the former law is continued in effect for that purpose.
