A BILL TO BE ENTITLED

AN ACT

relating to certain exemptions from requirements applicable to 
local permits.
	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:                       
	SECTION 1.  Section 245.004(9), Chapter 245, Local 
Government Code, is amended to read as follows:
		(9)  regulations to prevent imminent destruction of 
property or injury to persons from flooding, that are [including 
regulations] effective only within a flood plain established by a 
federal flood control program and enacted to prevent the flooding 
of buildings intended for public occupancy; or
	SECTION 2.  EFFECTIVE DATE.  This Act takes effect 
immediately if it receives a vote of two-thirds of all the members 
of each house, as provided by Section 39, Article III, Texas 
Constitution.  If this Act does not receive the vote necessary for 
immediate effect, this Act takes effect September 1, 2003.
