A BILL TO BE ENTITLED
AN ACT
relating to requiring a state agency to notify a member of the
legislature about certain expenditures that will affect the
member's district.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 306, Government Code, is amended by
adding Section 306.008 to read as follows:
Sec. 306.008. REQUIREMENT TO INFORM LEGISLATOR ABOUT
CERTAIN EXPENDITURES AFFECTING LEGISLATOR'S DISTRICT. A state
agency in the executive branch of state government shall promptly
inform a member of the legislature of the agency's decision to:
(1) build, expand, or substantially repair a road, a
bridge, or other infrastructure located in the member's district;
(2) build, expand, renovate, or substantially repair a
building or other facility in the member's district;
(3) purchase an item of capital equipment that will be
permanently or regularly located in the member's district; or
(4) award a grant or contract, other than a statewide
grant or contract, under which the entity to which the grant or
contract is awarded will implement one of the agency's programs:
(A) in the member's district; or
(B) in the member's district and in one or more
adjacent districts.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
